Mr Q – Run down whilst crossing the road.

Case Handler(s): Senior Solicitor assisted by Rebecca Hilton (Solicitor) and Donna Green (Paralegal)

Key elements of our client’s case

Mr Q was run down by the Defendant’s vehicle whilst crossing a road. Mr Q had pre-existing physical and mental health issues that meant that he was not able to work but was able to live independently. Post-accident his ability to care for himself was affected which meant that he moved to sheltered accommodation.

Both liability and the level of damages were in dispute.

Primary liability was admitted with offers being made on liability by the driver’s insurer that we rejected.

Where we added value to our client’s claim as a serious injury specialist

We agreed rehabilitation for the Claimant and jointly instructed a case manager who helped transition the Claimant from hospital into new supported accommodation , his previous accommodation being unsuitable due to mobility issues post-accident.

Reaching Settlement

The parties agreed to exchange of medical evidence and a Joint Settlement Meeting during lockdown that led to a settlement.

We agreed a discount of 33% for contributory negligence on Mr Q’s part which was a good compromise.

Damages were agreed at a considerable six figure sum after deduction for contributory negligence. A large part of this was for future care.
