The Incident
Our 32-year-old client was riding his motorcycle along Pound Lane in Basildon, Essex, when a driver pulled out from a minor road, crossing his path and causing a serious collision.
Injuries Sustained
The collision left our client with multiple severe injuries:
- Left Knee: Severed ligaments requiring multi-ligament reconstruction surgery (Schenck Type IV dislocation – damage to all 4 ligaments). Post-surgery, he wore a hinged brace and underwent physiotherapy. He remains with permanent pain, poor mobility and limited function which will be life long.
- Spinal Fracture: Treated conservatively.
- Shoulder and Rib Fractures: Comminuted left scapula fracture, fracture of the interior angle of the right scapula, and fractures to two ribs.
- Other Injuries: Contusions and lacerations to the right wrist and hand, a head injury, and significant psychological trauma.
- Secondary Pain: Ongoing pain in the hip, pelvis, and lower back as a result of the knee injury.
The Impact on Our Client’s Life
Following the accident, our client was unable to return to work full-time and struggled with financial stability. He eventually secured part-time employment with a family relative who understood his limitations.
The Case
Serious Injury Law was contacted to handle the claim, and the case was taken on by expert Associate and Charted Legal Executive, Victoria Martin.
Victoria’s determination to secure the best outcome for our client led to liability being admitted by the defendant.
During the case, our client underwent:
- A Functional Capacity Assessment to understand where he was limited but more importantly where his strengths could secure him employment.
- An assessment with an Orthotist to explore how orthotics could aid his recovery.
The settlement also included provisions for Vocational Support and Orthotics to help him transition into permanent part-time employment when ready.
The Outcome
The claim settled for a total compensation of £626,955, which will provide our client with the financial security and resources needed for his recovery and future employment opportunities.
