The incident
Our client was riding his motorbike in the centre of his own lane when another vehicle emerged from a side road directly into his path, resulting in a collision. Our client sustained serious injuries including a severe open fracture of the right tibia and fibula and a broken collarbone. Sadly, our client experienced recurrent infections to his leg, which meant he needed a below-the-knee amputation.
The case
Our client was represented by Partner and Senior Solicitor, Gerard Horton, alongside Chartered Legal Executive, Louise Cassidy. Counsel, Simon Kilvington KC was instructed of Byrom Street Chambers.
The aftermath
In the course of the case, substantial funds were secured from the other party by way of interim payments to further our client’s rehabilitation and support. We instructed a specialist case manager, Sue Brown, to manage the client’s rehabilitation journey.
Our client completed a course of residential rehabilitation at the STEPS rehabilitation facility, received specialist prosthetics advice, purchased a Can-Am Spyder Trike and purchased a new home, which is currently under construction.
The case outcome
Thanks to the hard work and expertise of our team, we were able to secure a significant settlement for our client of £4.1 million.
The settlement includes damages to meet our client’s future lost earnings, support needs, accommodation, transport and prosthetic requirements, amongst other aspects.
Importantly, the outcome also secured damages to enable our client to purchase a micro-processor-controlled foot, enabling him to secure the cutting edge in prosthetic components.
Following the case, Louise commented: “This was a tragic case of a young man who sustained life changing injuries following a motorcycle accident. It was a pleasure to work with the client alongside Partner, Gerard Horton, to help secure the compensation he deserved following a Joint Settlement Meeting. I hope the settlement reached helps him to continue focusing on his future and I wish him all the best.”
