Settlement achieved: a substantial six figure sum
We were instructed following a serious road traffic accident in which LM was a passenger in a car that was involved in a collision with another vehicle being driven by an uninsured driver. As a result of the accident LM suffered multiple injuries including spinal transverse process fractures, right arm fracture, left collar bone fracture, pelvis, sternum and rib fractures, Grade II liver laceration, iliac artery dissection and bowel injuries.
Claire was able to engage the Motor Insurers Bureau, via the Uninsured Drivers Scheme, at a early stage in the claim and used the Rehabilitation Code to afford LM access to private therapy which included:
- Physiotherapy
- 2 forms of psychological therapy
- Dietician
Investigations with the police were undertaken and an admission of liability achieved. Extensive expert medical evidence was required from:
- Consultant Spinal Surgeon
- Consultant Orthopaedic surgeon
- Consultant Vascular Surgeon
- Consultant General Surgeon
- Clinical Psychologist
The expert evidence was used to form a view on the future risks posed to LM in terms of pregnancy and future employment. Sensible and appropriate negotiations were undertaken and a substantial six-figure settlement was achieved without the necessity for court action
