Spinal injury case study 3

Our client, aged 53, was cleaning windows at a shopping centre when he fell 30 feet from his unsupported ladder. He sustained a burst fracture at T12, a serious head injury, psychological reaction, and fractured scaphoid.


The client initially contacted The National Accident Helpline and was referred to a firm of solicitors in London. However, they made very little progress with his case, and failed to appreciate the devastating effects of his injuries. No medical evidence was obtained. No witnesses were interviewed or statements gathered. No interim payments were obtained, despite the client’s desperately poor living conditions. No assessment was conducted of his immediate needs. Court proceedings were not commenced nor seemingly even contemplated. The client was extremely unhappy about the level of his solicitors’ client care and felt that they were simply not interested in his case or appreciated his plight. After a recommendation, and meeting with us within 48 hours at his home in London, the client decided to transfer instructions immediately.


We immediately established an understanding of the serious injuries sustained and identified his immediate needs. An action plan was implemented which resulted in the client receiving a significant interim payment to alleviate his financial concerns, and rehabilitation to help with his recovery – all of this notwithstanding the fact that liability was disputed.
A full immediate needs assessment was carried out, funded by the other side, which enabled us to obtain practical assistance for the client. We obtained evidence from experts in numerous fields, including neurological, orthopaedic, psychological, nursing, occupational therapy and rehabilitation. With the help of our dedicated in-house investigations unit and the involvement of senior counsel, we constructed a strong case on liability, and court proceedings were commenced within just a few months of us being instructed.


The client is now able to look forward to returning to live a meaningful life, provided with the care and medical treatment that he had been lacking for so long.
