A brain injury claim in the US has resulted in an $11 million (£7 million) payout for a family.
Kayla Mae McCraw was left with a brain injury meaning she will never be able to walk or talk after failures made during her delivery at Tripler Army Medical Center in 2005 in Hawaii.
Her mother Celia was showing signs of distress and doctors decided the baby had to be delivered immediately.
However, she waited an hour before the procedure began and Kayla Mae was born experiencing severe difficulties.
An endotracheal tube was then placed down her oesophagus instead of her trachea, resulting in oxygen being pumped into her stomach rather than her lungs for 40 minutes, resulting in the brain injury.
"What we had here is a series of egregious medical errors over a period of over two hours which resulted in severe brain damage," said the family's lawyer Michael Livingston.
The news comes after Premier Foods was fined for negligence resulting in a worker suffering a traumatic brain injury.
